The Senate passed a continuing resolution on August 8 that would extend the implementation of the new hemp rules for about a month. While we remain optimistic about a federal extension or a durable regulatory framework, the current stipulation is a 0.4mg total THC ceiling per container, effective November 12. The typical serving in today's hemp beverage market is 10mg.

A compliant 0.4mg SKU keeps your brand on shelf through the transition and opens accounts that will not stock a product carrying federal exposure.

Hitting that new target precisely, and proving it on a COA, takes a more nuanced approach to production and testing. We have worked with partners on 0.4mg drinks, and wanted to share recommendations based on what we have learned.

How to Hit 0.4mg in Production

Precision at 0.4mg in a 12oz can is a much tighter target than 10mg, and there is no comfortable direction to miss in. Above the cap you have a compliance problem. Below it you have a product problem. There is far less room for error at every step of the process.

Recommendation: Use a <0.3% THC emulsion for higher-precision dosing. Perfectly Dosed has months of data from selling and testing a <0.3% THC emulsion formula.

Lower concentration means smaller consequences for measurement drift. One gram of overage in a <0.3% emulsion adds about 3mg THC to the batch, versus about 50mg from the same overage in a 5% emulsion.

A <0.3% emulsion also stays below the total THC threshold that separates hemp from marijuana, even as a work-in-process ingredient.

As with other ingredients, expect some potency loss during production (oxidation, adhesion to tanks and lines, can liner scalping, and so on). Build a target overage into the batch to compensate, sized so the finished product lands at or under 0.4mg.

Recommendation: Test the tank before clearing product to package. This is the only checkpoint where potency can still be adjusted before the product is sealed in cans.

Recommendation: Bench-test your formula for can liner scalping. Scalping will likely affect potency over shelf life. Test your specific formula, dosed with <0.3% emulsion at 0.4mg THC, to establish the scalping rate you should expect in your product.

How to Test THC at 0.4mg

Four tenths of a milligram in a 12oz can is roughly 1.1 parts per million. Standard HPLC testing has LOQ limits that sit uncomfortably close to that. Even with an LOQ below 0.4mg, standard HPLC sample preparation methods are not reliable enough at this dilute potency.

Recommendation: Use LC-MS instead of HPLC. LC-MS is a significantly more sensitive testing methodology than HPLC, with LOQs that are orders of magnitude lower. Increased machine sensitivity produces more accurate results at low potencies.

Recommendation: Submit multiple cans (3+) per test. Like all testing methodologies, LC-MS carries some test-to-test variability. Multiple units give you a truer read on your beverage's actual potency and on the variation across units. That variation matters as much as the average, because compliance is judged one can at a time.

Formulation Factors That Complicate 0.4mg Dosing

Every hemp beverage is unique. Formula complexity, preservative systems, pasteurization, and other known drivers of potency loss all carry more relative weight at 0.4mg than they did at 10mg.

Recommendation: Avoid the ingredients and conditions that complicate consistent dosing at this potency. That includes fruit purees and sediment-prone ingredients, electrolytes and salts (especially multivalent cations), competing emulsifier systems, and extreme pH (below 3.3).
